The current publication by the National commission for human rights- Pakistan have revealed unprecedent increase in blasphemy cases due to its misuse and fragile social cum judicial structure which contribute to this dilemma. One can safely project if the it remain unchecked, sooner then later it will appear with more drastic impact the range from economics to relation with external world to the right to life in Pakistan. within the duration of only six month 292 cases have been filed in 2024 which targets the individual and minorities disproportionately. the victim is not only facing delay but the significant procedural violation start from police station to court room, prison and access to justice. this is very obvious from the recent case of Dr. Shahnawaz who has been gun down by the police personal. Such cases is no less then trauma and fear and threat to people voicing for improvement in these laws either through amending it as per need of time of changing the procedure for it. ضمانا للشفافيه و النزاهة وعدم اختراع العجله و حفاظ لحقوق المرضي و الاطباء معا في ان واحد . ١- طبعا القاضي هو الخبير الاعلي و المهيمن الاول وليست اللجان وهذا امر عالمي وتحدث عنه بوضوح في واقعه شهيره تغير فيها قانون الطب في إنجلترا .( حينما قامت لجنة من الاطباء بكتابة تقرير فاسد للدفاع عن طبيب ترك موقع عمله ولم ينقذ مريضه بحجة ان سبب الوفاة كان من شيء آخر ) تفتق ذهن القاضي ان هذا كلام منافي للعقل و المنطق و هذه اللجنه فاسده . وحكم بتعويض ولكن بالطبع لا يتم سجن اي طبيب لان الاطباء ليسوا مجرمين . وهذا الواقعه الشهيره غيرت الاصول الطبيه و طريقة اللجان و الشفافيه . ٢ . لضمان العدل و الشفافيه عمرنا ما شوفنا ولا هنشوف ان يبقي قاضي الصبح و بالليل فاتح مكتب محاماه مثلا . وبالتالي ما ينفعش اي عضو في اي لجنه يبقي بيحقق وبيكتب في قضيه لمستشفي و يبقي شريك من الباطن او مساهم في نفس المستشفي او غيرها ممن يعمل بها اصدقائه وشركاءه او يعمل في القطاع الخاص بالليل والصبح يبقي قاضي في اللجنه او يكون ليه درجات قرابة ممن لهم نفع مع المستشفي او عضو بجمعيات اهليه طبيه تنظم عمل كورسات تعليميه بهدف الربح ثم يكون قاضي لزملاء ليه بنفس الجمعيه … او يكون في قسم في الجامعه ويدعو قسم آخر لعمل مؤتمر ويكرم اصدقائه في نفس التخصص وفي اليوم التالي يكون هو المسؤؤل عن قضيتهم … أوجه تضارب المصالح و الصداقات طويلة الأمد والمتشابكه في هذا الموضوع مرعبه . والحل هو تعيين عدد من الاطباء في وزارة العدل و يتم مراقبة عملهم من الوزاره مع عدم عملهم في اي قطاع وعدم ظهورهم في مؤتمرات او جمعيات وذلك لضمان الحيده و النزاهه لانه لا يعقل ان يكون من يحكم علي طبيب هو منافس لطبيب او يعمل مع اطباء مشكو في حقهم و تجمعهم مصالح للعمل في القطاع الخاص . واللجان لابد ان تكون متنوعه من استشاريين التخصص و بقرعه معينه ولا تحتكر علي اماكن جامعيه فقط بعينها او أفراد بعينهم ويجب ان يكون عملها غير خاضع للأهواء وتكون اساسها علي الطب المبني علي الدليل وليس آراء شخصيه ويتم تسجيل النقاش العلمي او في حضور كافة الأطراف . ٣ اوراق اي قضيه طبيه لابد ان تكون سريه بمعني ان يتم ازالة اسماء المريضه والأطباء حتي لا يأخذ اخد العزه بالإثم او يشعر من يتعامل مع الملف بحرج ان هذا الطبيب او المستشفي يتعالج فيه أهله او اقرابه . ٤ الطب الشرعي هو عمود الخيمه و والأصل الأصيل و الدليل القاطع هو تشريح الجثه وفي حال رفض الأهل هذا الموضع قبل الدفن إذا أرادوا التقاضي لا تدفن الجثه إلا بعد عمل أشعات متفرقه عليها و اخذ كافة العينات بأبر او يطلب اهل المريض لجنة مدفوعه الاجر من الطب الشرعي تدفع من الصندوق تتحرك الي المريض وسط وجود اطباء من أهله و حضور وتوثيق الامر والا سوف تفتح باب الشك الدائم ورمي الناس بالباطل . ٣ الاطباء لا يسجنون في قضايا مسؤولية طبيه نهائي و القانون الجديد عباره عن كتل من العوار . حتي من يستأصلون عضو بالخطأ او ينسوا شاش في بطن مريض او يقومون بالتدخل الجراحي علي كلية سلميه بالخطأ بدل من المصابه لا يتم أبدا سجن طبيب في هذا النوع من القضايا والا سيسجن كل اطباء العالم بلا استثناء . ٤ التعدي علي الاطباء في العالم كله جريمه تصل الي ٣ سنين سجن علي الاقل . فمن غير المعقول ان واحد يولع في مستشفي و يدفع ٥٠ الف جنيه و يخرج . ٥ اما فكرة (preventive detention ) او الحبس الإحتياطي دي هذا جنون ما انزل الله به من سلطان لم ولن يطبق علي طبيب في العالم . ٦ كافة الدول تقوم بما يسمي (pre court ) يعني مرحلة مناقشات بين الجميع قبل التقاضي بين اهل المريض و المستشفي و الطبيب والأصل في الموضوع إسلامي وديني بحت وهو الديه الشرعيه لان لا يوجد طبيب في العالم كان هدفه ايذاء او قتل انسان ) ويكون الحساب هو تعديل وضع المؤسسه والطبيب . هذا الامر يمكن ان يحدث طبعا تحت امرة واعين القضاء مثل قضاء التحكيم والذي يمكن فيه التفاوض وحل النزاع تحت أعين القضاه و ضمان حق الرد للطبيب والمستشفي و المريض ويتسارع الجميع للتمسك بالشرع والعدل في جو من التكافل وليس العداء . ٧ بالنسبه للسيد المحامي الفاضل الذي ظهر إعلاميا ونفي دور الإقرار وانه لا يشفع… معذرة طبعا اقرار دخول العمليه هو المرجع والأساس طبقا لقانون مونتجومري الإنجليزي .. راجع الفيديو في الكومنتات ٨ المليارات التي سوف تجمع من هذا القانون يجب ان تكون لها ميزانيه واضحه وتكون هنا سقف للتعويض حتي لا تتحول المنظومة الي جشع مرعب واستغلال هذا الصندوق . تم توضيع كافة تلك النقاط و اكثر في فيديو كامل بالحجه و الأدلة من القوانين الدوليه اللهم اني بلغت اللهم فا اشهد ويعلم الله انني اتمني الخير للجميع مرضي وأطباء واتمني العدل و النزاهه والخير للجميع وبنيه صافيه #قانون_المسؤولية_الطبيه #د_البنا_مصر
